1. Acceptance of Terms

By downloading, installing, or using the Chat to Lose Weight mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Chat to Lose Weight ("we," "us," or "our").

2. Description of Service

Chat to Lose Weight is an AI-powered weight loss coaching application that provides:

• Personalized meal logging and analysis
• AI-driven coaching and guidance
• Weight tracking and progress visualization
• Dietary recommendations and habit formation support

3. Eligibility

Age Requirements

This app is intended for users 18 years and older only.

By downloading and using this App, you confirm that you are at least 18 years of age and meet all eligibility requirements.

Health Disclaimer

This App is not suitable for individuals with:

• Eating Disorders: Including anorexia nervosa, bulimia nervosa, binge eating disorder, or other restrictive eating patterns
• Pregnancy or Breastfeeding: Calorie and macro recommendations may not be appropriate
• Serious Medical Conditions: Diabetes, heart disease, kidney disease, or other conditions requiring medical supervision
• Medication Interactions: If weight loss may interact with your medications
• Mental Health Crises: If you are experiencing suicidal thoughts or severe depression

If you have any health concerns, consult your doctor before using this App.

4. Account Registration and Authentication

Authentication Methods

You can create an account using:

• Sign in with Apple: Secure authentication via your Apple ID

• You are responsible for maintaining the confidentiality of your credentials
• You agree to provide accurate and current information during onboarding
• You may not share your account with others
• Notify us immediately at hello@chattoloseweight.com if you suspect unauthorized access

5. User Responsibilities

Prohibited Uses

You may NOT:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or hack the App
• Share your account credentials with others
• Use the App to promote eating disorders or unhealthy behaviors
• Attempt to overload or disrupt the App's infrastructure

6. Subscription and Billing

Free Tier

The Free tier includes limited features and usage quotas for AI coaching interactions, meal logs, and data storage.

Paid Subscriptions (Essential & Pro Tiers)

• Billing: Subscriptions are billed through Apple's In-App Purchase system
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Free Trial: 7-day free trial for first-time subscribers; you will not be charged until the trial ends
• Cancellation: Manage subscriptions in your iPhone Settings → [Your Name] → Subscriptions
• Refunds: Refund requests are handled by Apple according to their refund policy

7. Intellectual Property

The App, including all code, design, logos, and content, is owned by Chat to Lose Weight. "Chat to Lose Weight" name and logo are our trademarks. You may not copy, modify, or distribute our intellectual property without permission.

You retain ownership of your personal data and content. We do not claim ownership of your meal photos, chat messages, or logs. You can export or delete your data at any time.

8. Health and Medical Disclaimers

Consult Your Healthcare Provider

ALWAYS seek the advice of a physician or qualified healthcare provider:

• Before starting any diet or weight loss program
• If you have pre-existing medical conditions (diabetes, heart disease, thyroid issues, etc.)
• If you are pregnant, nursing, or planning to become pregnant
• If you are taking medications that affect weight or appetite
• If you experience adverse symptoms while using the App

Emergency Situations

If you experience a medical emergency (chest pain, severe allergic reaction, suicidal thoughts, etc.), call emergency services immediately (911 in the US). Do not rely on the App for emergency assistance.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for details on:

• Your rights to access, export, and delete data
• Third-party services (Anthropic Claude API, Supabase database, Railway hosting)

We are not responsible for third-party services' availability, accuracy, or policies. Third-party terms apply to their respective services.

11. Disclaimers and Warranties

As-Is Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• No Guarantees of Results: We do not guarantee you will lose weight or achieve specific health outcomes. Individual results vary based on many factors outside our control.
• AI Limitations: AI coaching may contain errors or inaccuracies. AI is not a substitute for human professional advice.
• Service Availability: We do not guarantee continuous or uninterrupted access to the App.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR:

• Health outcomes, weight changes, or medical complications
• Injuries resulting from following AI coaching or recommendations
• Adverse reactions to dietary changes
• Any health-related damages, direct or indirect
• Lost profits, data loss, or business interruption
• Damages exceeding the amount you paid us in the past 12 months

13. Termination

Your Right to Terminate

You may delete your account at any time in App Settings → Account → Delete Account.

Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Attempt to hack or disrupt the App
• Use the App for illegal purposes

Effect of Termination

• Account deletion is permanent and cannot be undone
• All your data will be deleted from our servers immediately
• You lose immediate access to the App
• Active subscriptions continue until the end of the billing period (no refunds for partial periods)

14. Data Access, Export, and Deletion

How to Delete Your Account

You can permanently delete your account and all associated data by:

1. Opening the app → Settings → Account
2. Tap "Delete Account"
3. Confirm the deletion (requires two confirmations)

What Gets Deleted:

• ✅ All chat messages and coaching history
• ✅ All meal and weight log entries
• ✅ Your user profile (name, age, preferences)
• ✅ Daily summaries and memory facts
• ✅ App settings and preferences

Deletion Timeline:

• Local data: Deleted immediately from your device
• Backend data: Deleted immediately from our servers

How to Export Your Data

Before deleting your account, you can export your data:

1. Settings → Data Management → "Export Chat & Meals"
2. Choose where to save the JSON file (email, drive, etc.)

Exported Data Includes:

• Complete chat history
• All meal entries with nutritional details
• Weight logs
• User profile summary
• Export statistics (total calories, macros, etc.)

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Material changes will also be communicated through the app.

Your continued use of the App after changes constitute your acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the App shall be resolved in the courts of California.

17. Acknowledgment

By using this App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You also acknowledge:

19. Entire Agreement
